Welcome to LORISITY. The terms "we", "us" and "our" refer to LORISITY. LORISITY operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). LORISITY is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. By agreeing to these Terms of Service, you represent that you are at least the age of majority in your place of residence, or that you have given consent for any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You represent that all information you provide is correct, current and complete. You are responsible for maintaining the security of your account credentials and for all activity under your account.

SECTION 2 - OUR PRODUCTS AND ARTWORKS
LORISITY offers original artworks and other art-related products. We make every reasonable effort to display and describe each artwork as accurately as possible. However, colors, tones, textures, proportions and other visual characteristics may appear slightly different depending on your screen, device settings and lighting conditions. Original artworks are handmade and unique. Natural variations, visible brushwork, texture and other characteristics inherent to an original artwork are not considered defects. All descriptions, availability and prices may be updated without notice. Original artworks are one-of-a-kind unless expressly stated otherwise, and availability cannot be guaranteed until an order has been accepted and payment has been successfully received.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. LORISITY reserves the right to accept or decline an order where reasonably necessary, including in cases of payment issues, pricing or listing errors, suspected fraud, shipping restrictions or circumstances that make fulfillment impossible. An order is considered accepted once payment has been successfully received or, in the case of a bank transfer, once the payment has cleared and the order has been confirmed by LORISITY. Please review your order carefully before submitting it. Any cancellation, return or refund is subject to our Return and Refund Policy and any rights that cannot legally be excluded under applicable consumer law.

SECTION 4 - PRICES AND PAYMENT
Prices displayed on the website are shown in the currency indicated at checkout. Unless otherwise stated on the relevant product page or during checkout, the displayed price includes standard shipping to destinations currently supported by LORISITY. Any customs duties, import taxes, local taxes, brokerage charges or other charges imposed by the destination country are not included unless expressly stated otherwise and may be the responsibility of the customer. Available payment methods may include PayPal and bank transfer, as displayed at checkout. For bank transfers, an order will not be considered paid until the full payment has been received and cleared. Prices and availability may change without notice, but changes will not affect orders that have already been accepted.

SECTION 5 - SHIPPING AND DELIVERY
We take particular care when preparing and packing original artworks for shipment. Shipping is available only to destinations supported by LORISITY at the time an order is placed. Unless otherwise stated, standard shipping to supported destinations is included in the artwork price. Delivery times are estimates and cannot be guaranteed. International shipments may be affected by customs processing, carrier delays or circumstances outside our reasonable control. Where appropriate, artworks may be shipped with tracking and insurance. If an artwork arrives damaged, appears to have been damaged in transit, or does not arrive as expected, please contact us as soon as possible at kareen.kalush@gmail.com. Please retain all original packaging and provide photographs of the artwork, packaging and any visible damage so that we can assist you and, where applicable, make a claim with the carrier or insurer. Nothing in this section limits any rights or remedies available to you under applicable law.

SECTION 6 - INTELLECTUAL PROPERTY AND ARTWORK COPYRIGHT
photographs, text, graphics, videos, branding, logos and website content, is owned by or licensed to LORISITY and is protected by applicable intellectual property laws. The purchase of an original artwork transfers ownership of the physical artwork only. Copyright and all other intellectual property rights in the artwork remain with the artist unless expressly agreed otherwise in writing. The artist retains the right to reproduce the artwork, including the right to create and sell prints, limited editions, reproductions, and other authorized uses of the artwork. Purchasing an original artwork does not grant the purchaser the right to reproduce, copy, distribute, publish, commercially exploit, create derivative works from, or otherwise use the artwork or images of it for commercial purposes without prior written permission. Website content may be viewed for personal, non-commercial purposes only.

SECTION 7 - OPTIONAL TOOLS
We may provide access to tools or services offered by third parties. We do not control such third-party services and provide access to them on an "as is" and "as available" basis. Your use of third-party tools is at your own discretion and may also be subject to the terms and policies of the relevant provider.

SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to third-party websites or services. We are not responsible for the content, accuracy, availability, policies or practices of third-party websites. If you choose to access a third-party website, you do so at your own discretion. Any concerns regarding third-party products or services should be directed to the relevant third party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
LORISITY is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with LORISITY. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and LORISITY, including any injury, damage or loss resulting from purchased products and services.

SECTION 10 - PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, certain personal information may also be collected and processed by Shopify and other service providers necessary to operate the store, process payments, provide shipping and deliver other Services. Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to artwork descriptions, pricing, availability, shipping or other information. We reserve the right to correct such errors and update information where reasonably necessary, including after an order has been submitted, subject to applicable law. If an error materially affects an order you have already placed, we will contact you where appropriate.

SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes. You may not use the Services to violate applicable law, infringe intellectual property or other rights, transmit malicious code, collect personal information unlawfully, interfere with the security or operation of the website, impersonate another person or entity, or engage in fraudulent or abusive activity. Unauthorized copying, scraping, reproduction or commercial exploitation of LORISITY content or artwork is prohibited to the extent permitted by applicable law.

Automated tools, bots, agents or similar technologies may not access or interact with the Services in a manner that circumvents security measures, access restrictions or other technical controls. To the extent permitted by applicable law, you agree to indemnify LORISITY against third-party claims arising directly from your unlawful use of the Services, infringement of third-party rights, or material breach of these Terms.

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
